Communications Terms
Pilot Version 1.1.0
These terms apply when your Organization turns on email delivery or connects an SMS provider. They are part of the Pilot Terms of Service. In these terms, "we" and "us" mean Cyriac Labs, LLC, which operates Scene Lead. You will be asked to accept them when you turn on email or connect SMS; if your Organization accepted an earlier version, you will be asked to accept this one before you next make a change after it is published.
1. Sending is off until you turn it on
Nothing is emailed or texted to your customers until your Organization turns sending on. Until then, the Service composes and records messages but delivers nothing externally. When a customer pays through the Service's Stripe checkout, Stripe sends them its own receipt; that is Stripe's email, not a message from the Service.
2. How messages are sent, and whose they are
- Email is sent on your Organization's behalf by the Service's own email service, from "your Organization's name via Scene Lead", with replies going to the reply-to address you give when you turn email on. You do not need an email provider account of your own. - SMS is sent through your own SMS provider account, using the credentials and sender number you connect. - Either way, the messages are yours: they go to your recipients about your registrations, waitlists, classes, events and bookings, and you are the sender for legal purposes. The Service does not send marketing campaigns by email.
3. Consent and opt-outs — your obligations
- You must have the consent your jurisdiction requires before messaging a person (for SMS in the United States, that generally means prior express consent, and prior express written consent for marketing). - Opt-outs are enforced on every future send: an SMS STOP reply, an email that bounces or is reported as spam, and a person your managers mark as not to be contacted each create a suppression that the Service applies to that address or number. When someone asks you to stop by any other route, you must mark them. You must not attempt to bypass suppressions. - You must include the identification your channel requires. For email, the Service puts your Organization's name in the sender and a reply-to address that reaches you; for SMS, you are responsible for sender identification and opt-out language where required.
4. Registration and carrier requirements (SMS)
US application-to-person SMS requires carrier registration tied to YOUR business identity, arranged through your own messaging provider. You are responsible for the accuracy of registration information; carrier fees, throughput caps, and filtering decisions are outside our control.
5. Costs and limits
We charge nothing for email or SMS during the pilot. Email needs no provider account of yours. SMS is billed to you by your own SMS provider under your agreement with them. Email has daily sending limits, per Organization and per recipient; a message over a limit waits and is sent later rather than being dropped. If we ever introduce charges for communications, they will be described in an updated version of these terms requiring your explicit acceptance first.
6. Suspension for abuse
Deliverability is shared infrastructure. We may pause sending for an Organization whose messages generate complaint or bounce rates that threaten other Organizations, or that violate the Acceptable Use Policy, and we will tell you when we do.
